The following Terms and Conditions are to be carefully
read before using this website operated by Howe Fencing & Sectional Buildings.
By accessing or using our website you agree to be legally bound by these
Terms and Conditions as they may be modified and posted on our website from
time to time.
When confirmation of order is received, this is to indicate that we have received
your order. It does not indicate that a contract exists between us. We will
indicate acceptance of your order, and hence a contract between us, when we
send you an invoice. We have included this term to protect us in the case that
a mistake has been made in pricing, we have inadvertently under-priced goods,
or we are no longer able to supply a particular product for some reason. In
the case of a change of price, we will always contact you first to ensure that
the price is acceptable.
We may change the advertised price of a Product at any time. The price you
pay will be the price advertised at the time of your Order. We endeavour to
ensure displayed Prices on our website are correct at all times. If a Price
error arises, we will inform you of the product's correct price and you may
choose to either proceed with or Cancel the Order.
Howe Fencing & Sectional Buildings are entitled to
refuse any Order placed by you.
You undertake that all details you provide to us for the purpose of purchasing
Products or services which may be offered by us on our website will be correct,
that the credit, debit card or cheque which you use is your own and that there
are sufficient funds or credit facilities to cover the cost of any Products
or services. We reserve the right to obtain validation and verification of
the authenticity of your credit or debit card details before providing you
with any Products or services.
1. DEFINITIONS
Seller means Howe Fencing & Sectional Buildings, Standon Road, Standon,
Nr. Ware, Herts. SG11 2PU and the company’s website www.howefencing.co.uk
Customer means the person or company to whom this document is addressed.
Supplier means Howe Fencing & Sectional Buildings.
2. GENERAL
These terms and conditions are applicable to the supply of products by the
Seller, hereafter referred to as Howe Fencing & Sectional Buildings, and
to the buyer hereafter referred to as the Customer. All buildings are made
to metric measurements; Imperial measurements give an indication of size only.
3.
PRICE
All prices are quoted in Pounds Sterling and are inclusive of VAT (as may be
prescribed by law from time to time), unless otherwise specified.
4. PAYMENT
Payments must be made in Pounds Sterling only, unless otherwise specified,
and by one of the following payment methods:
Major credit cards: Mastercard, Visa, Switch, Solo, Visa Delta.
Cheques made payable to Howe Fencing & Sectional Buildings.
Bank transfer.
Official purchase order, to be paid on pro-forma invoice
5. PASSING OF RISK
The risk in the goods shall pass to the customer as defined in clause 6.3 below.
6.
DELIVERY
6.1 Delivery Date.
Any date or period for delivery shall be considered as indicative only, although
it is our policy to try to fulfil all orders within 21 days. Howe Fencing & Sectional
Buildings cannot be held responsible for delays in the delivery caused by any
other third party. If delivery is not within the agreed time we will, with
the agreement of the customer, arrange another time for delivery. If we cannot
agree another time for delivery Howe Fencing & Sectional Buildings will
offer the Customer a refund. 6.2 Shipping
All products must be signed for. 6.3 Passing of Risk
The Customer bears the risk once the goods have been signed for. 6.4 If the
delivery cannot be made, re-deliveries may be chargeable.
7. ACCEPTANCE
Within 7 days of receipt the Customer shall inspect the goods. It will be
taken by Howe Fencing & Sectional Buildings that the goods have been accepted
by the Customer unless the Customer shall have notified the Seller that the
goods are rejected. (This does not however affect the customer’s statutory
rights). If no such action has been taken, Howe Fencing & Sectional Buildings
shall consider the products being as described, of satisfactory quality and
fit for their purposes, and may not accept any reject at a later date.
8. RETURN
PROCEDURE
8.1 If the goods are to be rejected in the time limit set
in clause 7 above, the customer shall comply with the return procedure as defined
in clause 8.2 below. Howe Fencing & Sectional Buildings will not accept
any returned goods should the return not follow the aforementioned return procedure. 8.2 The customer must contact Howe Fencing & Sectional Buildings customer
services on 01920 822055 and obtain a Returns Number (RN). This number shall
be clearly quoted on the returned package. Howe Fencing & Sectional Buildings
will arrange for the package to be collected. A collection fee may apply to
returns where goods are not damaged or faulty. 8.3 In cases where the goods are rejected within a reasonable
time, the Customer is entitled to a full refund or replacement. The faulty
or damaged product must be returned to the Supplier before the refund or replacement
can be issued. Refund is within 30 days of cancellation.
9. CANCELLATIONS
9.1 Cancellations are only accepted if the Customer complies with the following
cancellation procedure. If the order has been dispatched prior to the cancellation,
the return procedure as defined in clause 8 (8.2 and 8.3) above will apply.
If the procedure is not respected, the order will be considered valid and the
Customer will remain liable for the full payment. 9.2 Cancellations can be made with Howe Fencing & Sectional
Buildings support line on 01920 822055. Customer will be provided with a Cancellation
Number (CN) for them to keep for future reference.
10. LAW
These terms and conditions are governed and shall be interpreted in accordance
with UK law.
General
All sizes stated are approximate.
Howe Fencing reserves the right to modify design and/or specification.
Allowances should be made for roof overhang.
All buildings should be assembled onto a firm, level base.
All optional extras must be ordered with a building.
All timber buildings should be given a coat of timber treatment/preserver during or immediately after assembly.
Wood is a natural product and is therefore prone to changes in appearance, including some warping, movement and splitting, particularly during unusual climatic conditions (long hot or wet spells of weather). As a natural occurrence this is not covered by a guarantee.
Most buildings are shown decorated with flowers, tools, toys, etc ? These are for photographic purposes and are not included in the sale of the building.
